With over 14 years of multifaceted professional experience spanning law, finance, and technology regulation, Abhishek Gupta brings a unique dual lens approach to legal problem solving; grounded both in frontline banking experience and refined legal expertise. A graduate of Symbiosis Law School, he holds degrees in Law (LL.B.) and Socio-Legal Sciences (B.S.L.). Before entering legal practice, he served as a Chief Manager with one of India’s top private sector banks, where he was involved with high-stakes insolvency, debt recovery, and distressed asset resolution.

Abhishek’s practice today lies at the intersection of white collar crime, financial regulation, insolvency, and technology law. He advises clients ranging from high growth startups in the tech and media sectors to large financial institutions and corporate debtors navigating regulatory investigations, insolvency proceedings, or commercial disputes. Key Experience

My professional journey can be broadly categorized into three interwoven domains—Banking and Insolvency, White-Collar Crime and Financial Regulation, and Technology, Media & Telecommunications (TMT) law. Each of these domains has been shaped by hands-on experience in financial services and deep legal advisory roles.

1. Technology, Media & Telecommunications (TMT)

I advise a range of clients in the TMT sector—from digital startups to established multinationals—on incorporation, regulatory analysis, and compliance frameworks across multiple jurisdictions. My work often involves:

  • Assessing jurisdiction-specific regulatory exposures based on evolving business models (e.g., OTT platforms, fintechs, data-driven businesses).
  • Establishing regulatory compliance structures in cross-border settings, especially in regions with emerging tech laws and data localization norms.
  • Representing TMT clients before courts and quasi-judicial authorities in disputes involving allegations of criminal misconduct, breach of statutory obligations, and commercial disputes.
2. White-Collar Crime, Cybercrime, and Financial Frauds

I regularly appear before Indian criminal courts and quasi-judicial forums, representing clients involved in high-value and complex financial frauds and cybercrimes. My involvement includes:

  • Advising victims of financial crime on asset tracing, recovery, and cross-border prosecution strategies.
  • Defending individuals and corporates accused of economic offences, including cyber-enabled frauds, money laundering, and breach of trust.
  • Guiding and overseeing forensic audits, fund-tracing exercises, and other investigative tools that are often critical in both prosecutorial and defensive legal strategies.

My approach goes beyond legal representation—I often act as the strategic advisor and coordinator for investigative and compliance teams involved in uncovering or defending against economic offences.

3. Banking, Insolvency & Debt Recovery

With nearly a decade of banking experience before transitioning into full-time legal practice, I bring a banker's instinct to my legal strategy. I have worked extensively in the financial distress and insolvency units of the Indian banking industry, offering a rare dual perspective in matters such as:

  • Representing both creditors and debtors before the National Company Law Tribunals (NCLT) and Debt Recovery Tribunals (DRT).
  • Advising corporate debtors in distress, helping them negotiate structured solutions through IBC proceedings, restructuring, and arbitration.
  • Assisting financial institutions in the enforcement of security interests, asset recovery, and resolution through litigation and alternative dispute resolution mechanisms.
  • Conducting legal due diligence and structuring of complex banking transactions, including securitisation and credit facilities across various instruments.
4. Commercial Arbitration and Dispute Resolution

I also act as counsel in high-value commercial arbitrations—both domestic and international—especially where the disputes stem from financing transactions, consortium lending arrangements, or insolvency-related commercial contracts. I assist in drafting of claims, legal strategy, and enforcement of arbitral awards.
